In Germany, employees have the legal right to co-determination when new technology is introduced via the Works Constitution Act. But in practice, AI systems for employee monitoring, productivity measurement, and selection are deployed without informing the works council. Research from the Hans Böckler Foundation shows that in more than 40% of cases, co-determination is bypassed.
